Subsequently, the Legal Department of the Judiciary was asked about the possibility of re-filing the settlement of the facility cases, as well as the cases against which a final verdict has been issued. Paragraph "a" of the Legal Department’s response, considering the invalidity of interest rate conditions in excess of the profits of the Central Bank, regardless of whether the facility file is closed or not, allows the lawsuit of annullment and the oblige the courts to refund the additional amount. And In paragraph (b), with reference to the withdrawal of the Uniform judicial precedent from the resolved cases and the cases in which a final verdict has been issued, as well as the necessity of public economic order, consider these two categories non-audible. The analysis of the theory indicates that, firstly, there is no ability to combine the sentence of paragraph A and B , and secondly, the relationship between the sentence and the argument in paragraph "A" to paragraph "B" is examined from the perspective of priority and rule over each other.  Finally, it seems to be possible to say that those who settled their facility case without going to court before the Uniform judicial precedent, as well as those whose claims for annulment of the interest rate condition in excess of the allowed profits were rejected by a final verdict can file an action to refund the additional amount}, keywords = {Bank Facilities,Central bank,Uniform judicial precedent,Advisory Opinion}, title_fa = {بررسی و نقد نظریه مشورتی ادارة کل حقوقی قوه قضاییه درخصوص سود مازاد بر نرخ مصوب در پرونده‌های مختومة تسهیلات بانکی (ناظر به رأی وحدت رویة دیوان عالی کشور به شماره 794)}, abstract_fa = {رأی وحدت رویه شماره 794، در تاریخ 21 مردادماه 1399 ناظر بر بطلان شرط مندرج در قرارداد اعطاء تسهیلات بانکی نسبت به سود مازاد بر مصوبات بانک مرکزی صادر شد که بر اساس آن "... شرط مندرج در قرارداد اعطاء تسهیلات بانکی نسبت به سود مازاد بر مصوبات مذکور باطل است...". متعاقب آن، سوالی درخصوص امکان طرح مجدد پرونده‌های تسهیلاتی تسویه‌شده و نیز دعاوی که حکم قطعی درخصوص آن‌ها صادر شده است به اداره کل حقوقی قوه قضاییه واصل شد. بند "الف" از پاسخ اداره حقوقی، با عنایت به بطلان شروط نرخ سود، نسبت به مازاد، صرف‌نظر از مختومه شدن یا نشدن پرونده تسهیلاتی در بانک، امکان طرح دعوی ابطال شرط اضافه نرخ سود تسهیلات و استرداد مبلغ اضافی را مجاز و دادگاه‌ها را مکلف به رسیدگی اعلام می‌کند، و در بند "ب" با استناد به انصراف رأی وحدت رویه از پرونده‌های تسویه‌شده و دعاوی که حکم قطعی درخصوص آن صادر شده است، و نیز اقتضا نظم عمومی اقتصادی، دعاوی ناظر به این دو دسته را قابل استماع نمی‌داند. که تحلیل نظریه، حاکی از آن است که اولاً قابلیت جمع بین حکم بند الف و ب نظریه، وجود ندارد و ثانیاً نسبت حکم و استدلال مندرج در بند "الف" به بند "ب" نیز از منظر اولویت و حکومت یکی بر دیگری بررسی می‌گردد. درنهایت به نظر می‌رسد بتوان گفت کسانی که پیش از صدور رأی وحدت رویه، پرونده تسهیلاتی خود را بدون مراجعه به دادگاه تسویه نموده‌اند و نیز افرادی که دعوایشان مبنی بر ابطال شرط نرخ سود، نسبت به مازاد، با حکم قطعی رد شده است، می‌توانند در دادگاه برای استرداد وجوه اضافی پرداختی، اقدام نمایند.}, keywords_fa = {تسهیلات بانکی,بانک مرکزی,رأی وحدت رویه,نظریه مشورتی,سود بانکی}, url = {https://www.raayjournal.ir/article_246424.html}, eprint = {https://www.raayjournal.ir/article_246424_6458182bc37eb07ad0dd831c822a5fad.pdf} }
