Many prosecutors' offices are located across the country, and they have issued orders to force those responsible to enforce the law. The involvement of prosecutors in this issue is related to the revival of public rights in terms of the excessive importance of taxes in the public interest and the creation of potential problems arising from the transfer of cash to pay for medical services. With an analytical approach, this article seeks to critique and evaluate the legal aspects of prosecutors' involvement in the issue of requiring health care centers to use store terminals from the perspective of public law. Lack of communication network between prosecutors at the national level and the need for similar action in joint national and regional cases, the vacuum of the legal system in the field of guaranteeing the implementation of actions and orders of the prosecutor's office and the need to strengthen it, lack of comprehensiveness of orders, The use of the store terminal is not merely the obligation to install it and the necessity of documenting, reasoning and transparency of this type of orders in order to spread some works and the results of judgments and rulings on them, is one of the findings of the present analysis.}, keywords = {Public rights,Store Terminal (POS),Public Law Revival,prosecutor's office,Doctors' Tax,Tax Evasion}, title_fa = {واکاوی مقایسه ای دستور دادستانی ها مبنی بر الزام مراکز خدمات درمانی به استفاده از پایانه های فروشگاهی(POS) از منظر حقوق عامه}, abstract_fa = {با تصویب قانون بودجه سال 1398، مفاد بند‌ «ی» تبصره 6 که صاحبان حرف و مشاغل پزشکی، پیراپزشکی، داروسازی و دامپزشکی را مکلف به استفاده از پایانه‌های فروشگاهی در چهارچوب آیین‌نامه تبصره ۲ ماده ۱۶۹ قانون مالیات‌های مستقیم نموده، مورد توجه بسیاری از دادستانی‌های سراسر کشور قرار گرفته و آنان در راستای اجبار مکلفان به اجرای قانون، اقدام به اصدار دستوراتی نموده‌اند. ورود دادستانی‌ها به این مسئله، از حیث اهمیت زاید‌الوصف مالیات برای مصلحت عموم جامعه و ایجاد مشکلات احتمالی ناشی از حمل وجه نقد جهت پرداخت به مراکز خدمات درمانی، با موضوع احیای حقوق عامه مرتبط است. این نوشتار در صدد است با رویکردی تحلیلی، ابعاد حقوقی ورود دادستانی‌ها به مسئله‌ی الزام مراکز خدمات درمانی به استفاده از پایانه‌های فروشگاهی را از منظر حقوق عامه نقد و ارزیابی کند. عدم وجود شبکه ارتباطی میان دادستانی‌های سطح کشور و لزوم اقدام مشابه آنان در پرونده‌های مشترک ملی و منطقه‌ای، خلأ نظام حقوقی موجود در حیطه‌ی ضمانت‌اجرای اقدامات و دستورات ماهیتاً اداری دادستانی و لزوم تقویت آن، عدم جامعیت مخاطبان دستورات، الزام به استفاده از پایانه فروشگاهی نه صرفاً الزام به نصب آن و لزوم مستند، مستدل و شفاف بودن این نوع دستورات در جهت تسری بعضی آثار و نتایج آراء و احکام دادگستری بر آن‌ها، از یافته‌های تحلیل حاضر است.}, keywords_fa = {حقوق عامه,پایانه فروشگاهی (دستگاه POS),احیای حقوق عامه,دادستانی,مالیات پزشکان,فرار مالیاتی}, url = {https://www.raayjournal.ir/article_254503.html}, eprint = {https://www.raayjournal.ir/article_254503_ca915c122fc40ba9cfc5dc336d063821.pdf} }
