Government agencies need to acquire property and land in order to implement their programs in the public interest, and on the other hand, this must be done under conditions and restrictions. In this position, we are talking about urban plans (including comprehensive, detailed and short plans); Because the urban plans express the limits of these acquisitions and the permission of the government's actions by exercising its sovereignty and the power of Cairo, so it can be said that the necessity of these acquisitions is realized on the basis of urban plans. The preparation and approval of these plans regulate administrative possessions and prevent the violation of citizens 'rights, but the non-implementation of these plans and the survival of the effects of their approval on real estate, on the other hand, also violates citizens' rights that The verdict of the present is on this issue and can be examined and analyzed in this regard. This article seeks to evaluate the form and content of the ruling of the Branch of the Court of Administrative Justice on the requirement to issue a building permit for properties located in government projects after the expiration of the legal term and their non-implementation that In the end, the result of this evaluation, despite the formal and substantive criticisms of the arguments presented, is the confirmation of the result obtained from it.
