Abstract

Abstract

The legislator in the Islamic Penal Law approved in 2012 to adjust the country's criminal legal system, enacted new penal institutions to reform criminals and reduce the criminal population of prisons. In this regard, one of these institutions is the alternative punishment of imprisonment, which itself has different divisions and will be discussed and analyzed in the upcoming article "Free public services". And it is clear that the issuance of a sentence of punishment instead of imprisonment under the title of "property purchase" for a specific institution or organization or natural or legal persons, considering that it is not provided for in the law, has legal and legal problems. And it is not possible in the current legal criminal system of the country according to the related laws and guidelines ; Since the examination of this mandatory sale is the intersection of criminal law and private law, it is of particular importance. This article tries to deal with this issue in a specialized way and to point out its problems and defects.
